In this case, as Ms. Cook, an inside sales employee working from the Atlanta office and who also worked remotely from her home, alleges in the complaint, Accenture and N3 have repeated their prior unlawful pay practices, which was the subject of the Prior FLSA collective action case of Kendon Austin v. Accenture LLP and N3 LLC, which resulted in the settlement in the sum of $1,750,000.00, of permitting inside sales employees to continue to suffer to work off the clock through various alleged improper actions and conduct including a) misinformation and misleading them about entitlement to overtime pay, b) failing to accurate record all work hours, c) labeling them as salaried employees, d) pressuring them against claiming or complaining of overtime hours worked without pay, and e) automatically taking from them 1 hour of time and pay each day for a 1-hour meal break not taken in whole or part.
As the lawsuit here alleges, Inside sales representatives are by law non-exempt from overtime pay, whether paid on a salary or hourly basis, and any work performed beyond 40 hours must be paid as long as the employer knew or should have known the employees are doing this work.
The lawsuit seeks to recover overtime pay for anyone who worked for Accenture or N3 as an inside sales employee in the past 3 years to the present, plus fees and double the sum in liquidated damages.
